Swimming pools in France: safety, permits and tax

In-ground pool in France: compulsory safety device (€45,000 fine), planning declaration by size, development tax of €251/m² in 2026, property tax.

In short

Every private, unenclosed in-ground pool, new or existing, must be fitted with a safety device against drowning (article L134-10 of the code de la construction et de l’habitation, Construction and Housing Code). Four devices are accepted: barrier, alarm, cover or enclosure. Without a device, the owner faces a fine of €45,000 (article L183-13). On the planning side, a pool of more than 10 m² requires a déclaration préalable (prior declaration), and above 100 m² a permis de construire (building permit) (service-public.gouv.fr). The pool is subject to the taxe d’aménagement (development tax) on a flat-rate value of €251 per m² of pool in 2026, with no allowance (article 1635 quater J of the CGI, General Tax Code). Finally, it must be declared to the tax office within 90 days of completion, as it increases the taxe foncière (property tax).

The compulsory safety device

The obligation covers private, uncovered in-ground pools, new and existing, for individual or collective but private use, for example in a residential complex (service-public.gouv.fr, verified 13 February 2026). Each device must be designed to protect children under 5:

DeviceMain requirementStandard deemed compliant
Protective barrierPrevent a child under 5 from getting through without an adult’s helpNF P90-306
AlarmDetect any crossing and set off a siren, with controls out of a child’s reachNF P90-307
Safety coverPrevent accidental immersion and bear an adult’s weightNF P90-308
EnclosureMake the pool inaccessible once closedNF P90-309

The seller or installer must give the owner a technical note on how the device works and is maintained, and on prevention measures. Service-public.gouv.fr also recommends keeping a pole, a lifebuoy and a telephone nearby.

For holiday lets, the barrier, cover or enclosure must be installed and working before the tenant arrives; an alarm must be activated and working when the keys are handed over. The tenant must not disable these devices.

The penalty is heavy: “Failure to comply with the provisions of article L. 134-10 on swimming pool safety is punishable by a fine of €45,000” (article L183-13).

Which declaration to the town hall?

For an in-ground pool without a cover, it all depends on the surface area of the pool (service-public.gouv.fr, verified 31 January 2025):

Pool areaAuthorisation
Up to 10 m²None (prior declaration in a protected area)
More than 10 m² and up to 100 m²Prior declaration
More than 100 m²Building permit

With a cover more than 1.80 m high, a pool of 10 to 100 m² requires a building permit. An above-ground pool installed for 3 months a year at most (15 days in a protected area) needs no authorisation. Beyond that, the same area thresholds apply. In all cases, the PLU (local development plan) may impose its own rules.

Development tax

If the pool requires planning authorisation, it is subject to the development tax (service-public.gouv.fr). The pool itself is not taxable floor area, but it “is nevertheless taxed on a flat-rate basis per square metre” (BOFiP, official tax guidance, BOI-IF-TU-10-30-10): €251 per square metre under article 1635 quater J of the CGI, in force since 1 July 2026. The 50% allowance granted on the first 100 m² of a main residence does not apply to pools (BOFiP, BOI-IF-TU-10-30-20).

Example: an 8 m × 4 m pool, i.e. 32 m², gives a base of 32 × 251 = €8,032, to be multiplied by the rates voted by the commune (municipality) and the département. The detailed calculation and rates are in our guide to the taxe d’aménagement (development tax).

The effect on property tax

A pool increases the valeur locative cadastrale (notional rental value), the basis for property tax and the council tax on second homes, as long as it cannot be moved without being demolished, whether it is in-ground, semi-in-ground or above-ground (service-public.gouv.fr, verified 16 April 2026). Impots.gouv.fr specifies that a wooden pool may also be taxable if it required excavation work, if it is surrounded by a coping or a terrace, or if it is connected to water and electricity.

The declaration must be made no later than 90 days after completion of the works, in the “Biens immobiliers” (property) section of your account on impots.gouv.fr, or using form H1 sent to the property tax office. Declaring within this period gives you, unless the commune or inter-municipal authority decides otherwise, a full or partial exemption from property tax for 2 years (impots.gouv.fr). If the authorities spot an undeclared pool, they write to you and you have 30 days to put things right (service-public.gouv.fr).

FAQ

Does an above-ground pool need a barrier?

Article L134-10 covers “private unenclosed in-ground” pools. Service-public.gouv.fr nevertheless advises, regarding above-ground pools, fitting them with safety devices: check before doing without.

Is an ordinary pool tarpaulin enough?

No. You need a safety cover able to prevent a child under 5 from going under and to bear an adult’s weight; standard NF P90-308 is deemed to meet these requirements (service-public.gouv.fr).

What is the fine for having no safety device?

€45,000 (article L183-13 of the Construction and Housing Code).

How much is the development tax on a 32 m² pool?

The base is 32 × 251 = €8,032 in 2026 (article 1635 quater J of the CGI), to be multiplied by the local rates. There is no allowance for pools.

Do I have to declare my pool to the tax office?

Yes, within 90 days of the end of the works. This deadline is the condition for the temporary 2-year property tax exemption, unless the commune decides otherwise (impots.gouv.fr).

Which professional to consult

Before buying a house with a pool, ask the notaire (notary) whether the pool was declared to the town hall and the tax office. The agent immobilier (estate agent) can ask the seller for the technical note given by the installer of the safety device. If the pool is close to a property boundary, the géomètre-expert (chartered surveyor) can mark out the boundaries before the works.
