Foreclosure process in Oklahoma: steps, notices and deadlines

Oklahoma allows court or power-of-sale foreclosure. A power-of-sale lender must give a 35-day cure notice and 30 days' notice of sale.

In short

Oklahoma allows both court (judicial) foreclosure and, when the mortgage grants it, power-of-sale foreclosure without a court case (46 O.S. §§ 40-49). Before a power-of-sale sale, the lender must send a notice giving 35 days to cure the default and must serve a notice of sale at least 30 days before the auction. A homeowner can switch the case to court by written election at least 10 days before the sale.

Judicial or non-judicial?

Both exist; the mortgage decides which path a lender can use.

  • Judicial foreclosure. The lender sues to enforce the mortgage. The court enters judgment for the amount due and orders the property sold (12 O.S. § 686).
  • Power of sale. A mortgage may give the lender the right to sell the property after a default, without going to court, under the Oklahoma Power of Sale Mortgage Foreclosure Act. The mortgage must say, in bold and underlined type: “A power of sale has been granted in this mortgage.” (46 O.S. § 43). Even with a power of sale, the lender may choose to foreclose in court instead (§§ 43(D), 49).

Power of sale does not apply to certain agricultural loans, or to a homestead mortgage if the borrower has elected court foreclosure (§ 41).

Timeline step by step

Federal servicing rules come first. A servicer may not make the first notice or court filing for a foreclosure until the loan is more than 120 days delinquent, with limited exceptions such as a due-on-sale violation (12 CFR § 1024.41(f)).

Power-of-sale foreclosure

StepRuleSource
Notice of intent to forecloseCertified mail to the borrower. It must state the default, the amount needed to cure and that the borrower has 35 days from the date the notice is sent to cure and reinstate the mortgage46 O.S. § 44
Notice of saleServed in person (or published if the borrower cannot be found) at least 30 days before the sale; also published once a week for 4 consecutive weeks, first publication at least 30 days before the sale; recorded with the county clerk within 10 days after the notice of intent is complied with§ 45(B)
Homestead electionBorrower may demand a court foreclosure by certified-mail notice to the lender and a recorded copy at least 10 days before the sale§ 43(A)(2)(b)
AuctionPublic auction, any day except Sunday or a legal holiday, between 9 a.m. and 5 p.m.; a winning bidder other than the lender must post 10% in cash or certified funds within 24 hours if the lender requires it§§ 45(C), 46
DeedLender delivers a deed without warranty to the buyer§ 47

The Act sets separate minimums, not one overall number of days from first missed payment to sale. A new notice of intent is not needed after more than 3 defaults in 24 months (more than 4 for a homestead), each previously noticed (§ 44).

Judicial foreclosure

The texts I read do not give an overall judicial timeline, and no official source I read states one. They do give these fixed points:

  • A defendant must serve an answer within 20 days after being served with the summons and petition, unless the court sets a different time. A reservation of time can add 20 days (12 O.S. § 2012).
  • If the note or mortgage says “appraisement waived,” a court-ordered sale cannot be issued until six months after the judgment. Without that waiver, the property is appraised by three disinterested persons or a qualifying entity before sale (12 O.S. §§ 759, 760).
  • The sheriff mails notice of the sale at least 10 days before it and publishes notice for two successive weeks; the sale may not take place less than 30 days after first publication (12 O.S. § 764).
  • The court must hold a confirmation hearing, with written notice mailed at least 10 days before it. The court orders a deed to the purchaser only if the sale followed the law (12 O.S. § 765).

Right of redemption

The owner can redeem the property by paying what is owed, plus expenses, at any time after the debt is due and before the right to redeem is foreclosed (42 O.S. §§ 18, 20). In a power-of-sale foreclosure, the notice of sale must tell the borrower that he or she may redeem by paying all principal, interest and other secured sums before the deed is executed and delivered (46 O.S. §§ 43(B), 45(A)). The lender’s deed then conveys title without a right of redemption (§ 47(B)).

For judicial foreclosures, the statutes I read set no post-sale redemption period; the point at which the owner’s right ends is a legal question for an attorney. Do not assume you can redeem after the court confirms a sale.

Deficiency judgments

A deficiency is the unpaid balance left after the sale.

  • Judicial foreclosure. The lender must ask the court within 90 days after the sale for a post-judgment deficiency order. The court sets the property’s fair and reasonable market value on the sale date and the deficiency is the debt, interest and costs minus the higher of that value or the sale price. If no motion is made in time, the sale proceeds count as full payment of the mortgage debt (12 O.S. § 686).
  • Power of sale, non-homestead. The borrower is liable for a deficiency, but the lender must sue within 90 days after the sale. If the borrower proves the fair market value exceeded the sale price, the deficiency shrinks by the difference (46 O.S. § 43(A)(2)(d)).
  • Power of sale, homestead. The borrower can block a deficiency claim by sending a certified-mail notice electing against a deficiency judgment at least 10 days before the sale. The lender may still challenge the homestead claim within 90 days after recording its deed (§ 43(A)(2)(c)).

Help for homeowners in default

  • Talk to your servicer early. Under federal rules, a servicer that receives a complete loss-mitigation application more than 37 days before a foreclosure sale generally cannot move for judgment or conduct the sale until it has evaluated the application and any appeal rights have run (12 CFR § 1024.41(g)).
  • HUD-approved counselors. The Consumer Financial Protection Bureau (CFPB) offers a ZIP-code search and a phone line, 1-855-411-CFPB (2372).
  • Oklahoma Housing Finance Agency. Its Homeowner Assistance Fund portal closed to new applications on March 20, 2024. Check the agency’s site for any new program.
  • Legal help. An attorney can tell you whether your mortgage has a power of sale and how the homestead elections apply. See real estate attorneys in Oklahoma.

If you are buying a foreclosed home, the seller disclosure form is not required for foreclosure sales or sales by a lender that took the property back (60 O.S. § 838), so inspect carefully. See seller disclosure, closing costs and Oklahoma City.

Frequently asked questions

Does Oklahoma require foreclosure to go through a court?

No. If the mortgage grants a power of sale, the lender may sell the home without a lawsuit, after the notices required by 46 O.S. §§ 44-45. The lender can also choose court foreclosure, and a homeowner can demand it by written election at least 10 days before the sale.

How long do I have to catch up before a power-of-sale foreclosure?

The notice of intent must give you 35 days from the date it is sent to cure the default and reinstate the mortgage (46 O.S. § 44).

Can the lender still sue me after the sale?

Possibly, for a deficiency. Both court and power-of-sale foreclosures impose a 90-day deadline, and homestead owners can elect against a deficiency judgment in a power-of-sale case.

Can I get the house back after the auction?

For power of sale, no: the deed conveys title without a right of redemption (46 O.S. § 47). For court foreclosure, the statutes I read set no fixed post-sale period; ask an attorney.
