Foreclosure process in Nevada: notice, mediation and help

Nevada owner-occupants have 30 days after a Notice of Default to petition for foreclosure mediation. Federal rules add a 120-day wait. What we could source.

In short

A Nevada deed-of-trust foreclosure under NRS chapter 107 starts with a Notice of Default and Election to Sell. An owner-occupant then has 30 days to petition the district court for foreclosure mediation (Home Means Nevada). Federal rules add that a servicer “can’t start the foreclosure process until at least 120 days after you become delinquent” (CFPB). We could not open the Nevada Legislature’s site, so the statutory notice periods are not stated here.

What this page covers, and what it does not

The Nevada Legislature’s website (NRS chapter 107) and the Nevada Supreme Court’s website were blocked to our automated reader on October 13, 2026. We did not work around the block. As a result, this page does not state:

  • the minimum time between the Notice of Default and the sale;
  • how and where the sale notice is posted;
  • whether a former owner can redeem the home after the sale;
  • the rules on deficiency judgments.

Read NRS 107.080, 107.085 and 107.086, and ask a Nevada attorney before you rely on any date. What follows comes from the program administrator, the Clark County court, the Real Estate Division and federal agencies.

Judicial or non-judicial?

Both exist in the program’s own materials. Homeowners can enter the Foreclosure Mediation Program on receiving a Notice of Default and Election to Sell or on being served with a Complaint for Judicial Foreclosure. The Real Estate Division’s seller-disclosure form also refers to sales “by foreclosure pursuant to chapter 107 of NRS” (NRS 113.130(2)(a)). We found no official source that says which route is more common, so we make no claim about it.

The Foreclosure Mediation Program

Under rules the Nevada Supreme Court adopted on August 1, 2017, a qualified owner of an owner-occupied home may take part (Home Means Nevada, Rule 8):

  • upon a housing counselor’s recommendation;
  • upon receiving a Notice of Default and Election to Sell;
  • upon service of a Complaint for Judicial Foreclosure;
  • by mutual agreement of the parties.

Eligibility. The program page lists three conditions:

  1. a Notice of Default was filed on your property in the past 30 days;
  2. the property is your primary, owner-occupied residence, not a vacation home, second home or rental;
  3. you have no open bankruptcy under chapter 7, 11, 12 or 13 of Title 11.

What to do. Home Means Nevada says you must file a Petition for Foreclosure Mediation in District Court, pay a $25 filing fee, serve a copy on the beneficiary of the deed, Home Means Nevada and the trustee by certified mail (or electronically, if authorized), and pay “the appropriate fees” to the court. The program’s standard notice, in its 2018 version, warns: “YOU MUST ACT WITHIN THIRTY (30) DAYS. IF NO ACTION IS TAKEN, THE FORECLOSURE MAY CONTINUE,” and calls this “your only opportunity” to take part. You can instead waive mediation on a form returned to the trustee and Home Means Nevada.

Home Means Nevada says it does not decide eligibility, run the case or assign mediators. The district courts do. It also cannot give legal advice.

In Clark County, the court’s Alternative Dispute Resolution Office runs the program: (702) 671-4493. The court describes mediation as an informal process in which a neutral mediator helps the owner and lender “reach a mutually acceptable and voluntary agreement,” with decision-making authority resting with the parties.

Example: a Las Vegas owner-occupant misses the payment due March 1, 2026. The servicer may not start foreclosure until the loan is 120 days delinquent, about June 29, 2026 (CFPB). If a Notice of Default and Election to Sell is served on July 15, the 30-day window to petition ends August 14. If the lender answers within 10 days, a mediator is assigned within 10 days after that, and mediation should occur within 90 days of the assignment (Clark County court). This is an illustration of these particular deadlines, not a forecast of the sale date.

Federal protections

The CFPB says “your servicer can’t start the foreclosure process until at least 120 days after you become delinquent on your loan,” except in rare cases. It also says your servicer should receive a complete application “more than 37 days before your scheduled foreclosure sale.” If the servicer receives it at least 90 days before a sale, you may have a right to appeal a loan modification denial.

Help for homeowners in default

  • HUD-approved housing counseling. Free or very low-cost. Call (800) 569-4287 (TTY (800) 877-8339) as early as possible. HUD warns that you do not need to pay a foreclosure-prevention company, and to be careful with any firm that promises to stop foreclosure immediately.
  • Homeowners’ HOPE Hotline. (888) 995-HOPE, for conventional loans, per HUD.
  • Home Means Nevada. 702-789-7349 (2018 notice), for questions about the mediation process.
  • Legal aid and an attorney. The mediation notice recommends consulting an attorney about your rights and attaches a list of HUD-approved counselors and legal-services providers. That list is dated 2018, so confirm each contact.

What happens to a buyer at a foreclosure sale

The trustee and beneficiary must give a buyer written notice of defects they know of, no later than conveyance or when the buyer asks (NRS 113.130(4)). Unlike an ordinary seller, they do not complete the seller’s disclosure form. See seller disclosure in Nevada.

Frequently asked questions

How long do I have to ask for mediation?

No. The home must be your primary, owner-occupied residence.

Does this apply if I have filed for bankruptcy?

The program page says you must not have an open chapter 7, 11, 12 or 13 case.

Where can I get help paying my mortgage?

Start with a HUD-approved housing counselor at (800) 569-4287. See also our guide to FHA loans for loan-type options, and the Las Vegas page for local context.
