Real estate agents in California: what buyers ask
Who pays the real estate agent in California?
Commissions are negotiable and not set by law. Since August 17, 2024, offers of compensation are banned from the MLS and buyers sign a written agreement first.
What must a seller disclose in California?
A California seller must deliver a Real Estate Transfer Disclosure Statement (Civil Code 1102.6) and a Natural Hazard Disclosure Statement (1103.2). If either arrives after the offer, the buyer may cancel within 3 days of in-person delivery or 5 days if mailed or sent electronically.
